Terms of Service

Welcome to Taroterra! These Terms of Service (“Terms”) govern your access to and use of the Taroterra website, application, and services (collectively, the “Service”).

The Service is owned and operated by Individual Entrepreneur (FOP) Pundel Maria Markovna, registered under the laws of Ukraine (“Taroterra”, “we”, “us”, or “our”).

By registering an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. This document constitutes a Public Offer in accordance with Articles 633 and 641 of the Civil Code of Ukraine.

Disclaimer: This service is intended solely for entertainment purposes. Results generated using artificial intelligence are the output of an algorithm and should not be construed as professional advice (psychological, medical, financial, etc.). The user bears full responsibility for any actions taken based on the information provided. The service is not liable for any consequences resulting from the use of the content provided.

1. IMPORTANT DISCLAIMERS: ENTERTAINMENT & AI

1.1. For Entertainment Purposes Only. THE SERVICE, INCLUDING ALL TAROT READINGS, INTERPRETATIONS, AND GENERATED CONTENT, IS PROVIDED STRICTLY FOR ENTERTAINMENT PURPOSES ONLY. Taroterra does not provide actual fortune-telling, guaranteed predictions, or actionable life advice.

1.2. No Professional Advice. Information provided by Taroterra should NEVER be used as a substitute for professional medical, psychiatric, financial, or legal advice.

1.3. Artificial Intelligence (AI). Taroterra interpretations are generated using Artificial Intelligence (Google Gemini API). AI is an automated system that may produce inaccurate, irrelevant, or illogical responses (“hallucinations”). We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You rely on such content solely at your own risk. The User agrees and acknowledges that they are solely responsible for evaluating the risks and the accuracy of any generated content.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

2.1. Age Requirement. You must be at least 18 years old to use the Service. If we discover that a user is under 18, the account will be terminated immediately.

2.2. Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. PAYMENTS AND CREDITS

4.1. One-Time Purchases. Taroterra offers paid features through one-time purchases of “credits” (tokens). Credits are added to your account upon successful payment.

4.2. Complimentary Credits. We may provide welcome credits for testing purposes. These have no cash value, cannot be withdrawn, and may be revoked at any time.

4.3. Payment Processing. Payments are processed through a third-party payment service (or other available methods). We do not store your full credit card information.

5. SERVICE DELIVERY AND REFUND POLICY

5.1. Time of Service Delivery. The Taroterra service provides digital services that are delivered through the instant generation of content using artificial intelligence (AI) in response to a user’s request. The service is considered fully provided upon the successful generation and display of content on the user’s device. Since the result of the service is a digital product provided instantly, any subsequent claims regarding the “quality” or “effectiveness” of the content do not constitute grounds for a refund.

5.2. Exceptions and Technical Errors. We strive to provide the best user experience. Although, as a general rule, services are non-refundable, we are willing to consider individual requests in the event of technical malfunctions on the Service’s end (e.g., double charging or failure to credit funds after successful payment). 5.3. EU and UK Consumer Rights. In accordance with the EU Consumer Rights Directive (2011/83/EU), the user agrees that the provision of digital content begins immediately upon payment. By purchasing the service, the user expressly confirms that they are aware of the loss of their right to withdraw from the contract (the “14-day cooling-off period”) once the content generation process has been initiated and successfully completed.

6. PRIVACY & DATA

We process your personal data (name, date of birth, etc.) in accordance with our Privacy Policy. You have the right to delete your reading history or your entire account at any time.

7. INTELLECTUAL PROPERTY

All rights to the Taroterra platform, branding, and code are owned by us. You are granted a personal, non-exclusive license to use the generated readings for personal, non-commercial use only.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAROTERRA (FOP PUNDEL M.M.) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE OR YOUR RELIANCE ON ANY TAROT READINGS. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF FIFTY US DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE PAST SIX (6) MONTHS.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1. Governing Law. These Terms are governed by the laws of Ukraine. For EU residents, mandatory local consumer protection laws remain applicable.

9.2. CLASS ACTION WAIVER (US Residents). You agree to resolve disputes with us solely on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.

9.3. Informal Resolution. You agree to try to resolve any dispute informally by contacting our support email before filing any formal claim.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Taroterra (FOP Pundel M.M.), its affiliates, licensors, and service providers, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Prompts, any use of the Service’s content, services, and products other than as expressly authorized in these Terms, or your reliance on any Tarot readings or AI-generated information.

11. SERVICE AVAILABILITY AND MODIFICATION

11.1. Uptime. We strive to keep the Service operational, but we do not guarantee that it will be uninterrupted, error-free, or completely secure. The Service relies on third-party integrations (such as the Google Gemini API), and we are not responsible for downtimes caused by these providers.

11.2. Changes. We reserve the right to withdraw, amend, or discontinue the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

12. MISCELLANEOUS PROVISIONS

12.1. Severability. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

12.2. Entire Agreement. These Terms and our Privacy Policy constitute the sole and entire agreement between you and Taroterra regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

12.3. Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may freely assign or transfer these Terms without restriction.

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the site or via email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
